I. General Information

FUNDACIÓN FAMILIAR CATALANA, is a private foundation subject to the legislation of the Generalitat de Catalunya, domiciled at 08017 Barcelona, Inmaculada, 22, with Tax Identification Number G-58494907. Registered in the Foundations Registry of the Generalitat de Catalunya with number 303.

The FUNDACIÓN FAMILIAR CATALANA is registered in the Register of Groups of Interest of the Generalitat de Catalunya with the number 2.087.

This Legal Notice has been drawn up in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), Organic Law 3/2018 of 8 December on the Protection of Personal Data and guarantee of digital rights, and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.

This Legal Notice governs the use of the Portal, which may be accessed via the website belonging to CATALAN FAMILY FOUNDATION (hereinafter the fundaciofamiliarcatalana.cat). 

The aforementioned website has been designed to provide details on the information, activities and services offered by the CATALAN FAMILY FOUNDATION.

Use of the Portal confers the status of website user (hereinafter the User) and implies the full acceptance of each and every one of the provisions of this Legal Notice. The User should read this Legal Notice carefully each and every time he or she wishes to use the Portal, as the terms and conditions of use may be modified.

Access to the Portal is free except for the costs of connecting to a telecommunications network via a supplier hired for this service by the user.

The duration of this agreement is limited to use of the Portal and as a consequence the agreement will come to an end as soon as the User disconnects from the Portal.

 

II. Use of the Portal

The User should make sure to use the Portal correctly, in accordance with the law and this Legal Notice, and will be held liable for any damage that may be caused as a consequence of failure to comply with this obligation.

If the User wants to work with or contact the CATALAN FAMILY FOUNDATION via the Website, then he or she should fill in the details required in the data collection form. You must fill in all fields on this form in order to work with us, and their use is subject to our Privacy Policy.

Any information provided by the User via the contact forms on the Portal must be accurate. Accordingly, the User guarantees the accuracy of all the data provided and accepts the obligation to keep all the information sent to the CATALAN FAMILY FOUNDATION up to date at all times, so that it corresponds to the User's current situation; the User is solely responsible for any false or inaccurate statements made and any damages this may cause the CATALAN FAMILY FOUNDATION or third parties as a result of the information provided.

 

III. Links

If an internet user puts a link from their website to the Portal, this link should only go to the Portal homepage, without reproducing it in any way. If the content of the Portal may be viewed with content from third parties, then this content should not lead to mistakes, confusion or deception for the Users as to the origin of the content of the Portal, nor should it involve a comparison or a misleading imitation or exploitation of the reputation of the CATALAN FAMILY FOUNDATION.  

The website with the link should not make any kind of false or inaccurate statement about the CATALAN FAMILY FOUNDATION, its sponsors, employees or partners, nor should it indicate anywhere on said website that they have consent from the CATALAN FAMILY FOUNDATION to include the link, or that the CATALAN FAMILY FOUNDATION has any kind of relationship or partnership with said website.

Except in circumstances permissible by law or where expressly authorised by the CATALAN FAMILY FOUNDATION, whenever a direct link to the Portal is in place, it is forbidden to use any logo or other distinctive branding belonging to the CATALAN FAMILY FOUNDATION on the website on which the link is located.

The website that includes the link should comply with the law and there should not be any links to content that is illicit, immoral or against good practice.

On the other hand, the Portal may include links to technical devices that allow the User to access other websites or internet portals, with the CATALAN FAMILY FOUNDATION acting as an intermediary service provider in accordance with Article 17 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, which means the website is solely responsible for the content or services supplied on the linked websites where, as provided for by the Law on Information Society Services and Electronic Commerce, it has not deactivated any links despite having effective knowledge of the illicit nature of its content.

The existence of linked websites does not mean that there are agreements of liability or ownership, and the CATALAN FAMILY FOUNDATION is not liable for any damage incurred by the illegality, quality, unavailability, inaccuracy, inadequacy or out-of-date nature of the content of these websites, as it is unaware of the condition of said content. In any case, if the User becomes aware that any of the websites linked lead to web pages with illicit or immoral content or services, then the CATALAN FAMILY FOUNDATION should be duly notified.

 

IV. Intellectual and Industrial Property

The CATALAN FAMILY FOUNDATION reserves the right to all the logos, commercial names, branding and other distinctive signs, patents and intellectual property with regard to the content on this web Portal.

More specifically, the content that appears or may appear on the Portal (text, photos, images, icons, links etc.) belongs to the CATALAN FAMILY FOUNDATION or third parties that have given their express authorisation to the CATALAN FAMILY FOUNDATION for their use on the Portal. Under no circumstances should it be understood that the CATALAN FAMILY FOUNDATION provides the User with any license or that it renounces, transfers or cedes any rights, either in whole or in part, to said content; nor should it be understood that it gives the User the right to modify, use, reproduce, distribute or publicly share said content.

Equally, the logos, commercial names, brands and other distinctive signs shown on the Portal are the property of their respective owners. The User accepts that access to this internet service should not be understood as a tacit concession, in virtue of the doctrine of one’s own actions or by any other mechanism, of any license or right to use any logo, commercial name, branding or any other distinctive sign that features on this Portal, without the prior written consent of the CATALAN FAMILY FOUNDATION or the respective owners.

 

V. Responsibility

The CATALAN FAMILY FOUNDATION is in no way obliged to check the veracity, accuracy or current nature of the information shown on its website. The CATALAN FAMILY FOUNDATION may not be held responsible for any decisions taken using the information supplied on the Portal, nor for any damages caused to the User as a result of actions solely based on the information obtained on the Portal, given that the contents of the website are general in nature and do not constitute an offer of professional services of any kind, which means said information is insufficient for the User to take purely professional or business decisions.

Access to the Portal does not imply any obligation for the CATALAN FAMILY FOUNDATION to check for computer viruses or any similar damaging component, and it is the User's responsibility to have sufficient tools available in order to protect against harmful computer software, which means the CATALAN FAMILY FOUNDATION cannot be held responsible for any damages that occur to the computer equipment of the User or third parties while offering the service on the Portal.

The CATALAN FAMILY FOUNDATION is not liable for any damages to the User as a result of failure or disconnection from telecommunications networks where this results in the suspension, cancellation or interruption of the Portal's service either while it is being offered, beforehand or afterwards.

 

VI. Legislation

This Legal Notice is governed in each and every one of its clauses by Spanish law, and any dispute that may arise from the Legal Notice should be resolved by the Courts and Tribunals of Barcelona.
